By accessing or using the Spike Console website at www.spikeconsole.com and any services provided by Spike Console ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of services
Spike Console provides AI integration, workflow automation, and operations management services for businesses. Our services include discovery and consultation, custom AI workflow development, operations console setup, and ongoing support and maintenance as described in our service plans.
3. Subscriptions and payments
- Services are provided on a monthly subscription basis following an initial discovery and build phase.
- Prices are as listed on our pricing page and are subject to change with 30 days' notice.
- Payments are processed securely through Stripe. You agree to provide accurate and complete payment information.
- Subscriptions renew automatically each month. You may cancel at any time, and cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact us if you have concerns about a charge.
4. Your responsibilities
When using our services, you agree to:
- Provide accurate and up-to-date information about your business and operations
- Use the services only for lawful purposes and in accordance with these terms
- Maintain the security of your account credentials and notify us of any unauthorised access
- Not attempt to reverse engineer, copy, or redistribute any part of the platform
5. Intellectual property
All content, features, and functionality of the Spike Console platform, including but not limited to text, graphics, logos, software, and design, are owned by Spike Console and are protected by intellectual property laws. Custom workflows and automations built for your business are licensed to you for use during your active subscription.
6. Your data
You retain ownership of all data you provide to us or that is generated through your use of our services. We process your data in accordance with our Privacy Policy. Upon termination of your subscription, you may request an export of your data within 30 days.
7. Service availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.
8. Limitation of liability
To the maximum extent permitted by law, Spike Console shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of our services. Our total liability for any claim arising from these terms shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
Either party may terminate the service relationship at any time. You may cancel your subscription through your account or by contacting us. We may suspend or terminate your access if you breach these terms, with notice where reasonably possible. Upon termination, your right to use the platform ceases, but sections regarding intellectual property, limitation of liability, and governing law survive.
10. Changes to these terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the revised terms on this page and updating the "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
11. Governing law
These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of our services shall be resolved through good-faith negotiation before pursuing formal proceedings.
